Four\u00a0banks<\/b>, described as “bad apples<\/b>” in a 2006\u00a0cable<\/b>, sent to Washington by former US Ambassador in Sofia,\u00a0John Beyrle<\/b>, have filed a claim against the site for investigative journalism\u00a0Bivol<\/b>.bg.<\/p>\n

In July 2011,\u00a0Bivol<\/b>, official partner of\u00a0WikiLeaks<\/b> for\u00a0Bulgaria<\/b>, published the\u00a0cable<\/b>, titled “Bulgarian\u00a0Banks<\/b> Generally Healthy, but a Few\u00a0Bad Apples<\/b> Remain.”<\/a><\/p>\n

The alleged “Bad apples<\/b>,”\u00a0First Investment Bank<\/b>, FIB, of Tseko Minev,\u00a0Corporate Commercial Bank<\/b>, CCB, of Tsvetan Vasilev,\u00a0Investbank<\/b> of Petya Slavova, and\u00a0Central Cooperative Bank<\/b>, tied to the group TIM, have joint efforts in countering\u00a0Bivol<\/b>.<\/p>\n

All four have sent a claim to the Central Bank, (Bulgarian National Bank<\/b>,\u00a0BNB<\/b>) insisting it imposes a fine on the investigative journalists.<\/p>\n

BNB<\/b> have proposed the date of October 11, 2012, for the parties to meet and discuss the published materials and their possible effect on the stability of the country’s banking system.\u00a0Bivol<\/b> say they received the letter, dated October 5, too late (October 11) in order to be able to attend.<\/p>\n

“We, too, have questions for\u00a0BNB<\/b> \u2013 what affects more the stability of the bank system? Is it the probability that we have\u00a0banks<\/b> which deal with laundering money from local and foreign criminals and connected lending, as Beyrle wrote, or the fact it is being made public?”\u00a0Bivol<\/b> write.<\/p>\n

The journalists remind that the hushing of the said\u00a0cable<\/b> has violated to the highest extend public interest and has been reported as the top “taboo” topic in Bulgarian media for 2011.<\/p>\n

The “taboo” emerged after a panel from the Institute for Moderns Politics and the Friedrich Naumann Foundation made a content analysis of 10 Bulgarian newspapers.<\/p>\n

“Is society benefiting from such taboos? Is the sanctioning of inconvenient publications contributing to freedom of speech in a country at the bottom of freedom of speech rankings by international organizations? These are the topics we would propose for discussion to\u00a0BNB<\/b>,”\u00a0Bivol<\/b> conclude.<\/p>\n

Below is the translation of the\u00a0BNB<\/b> letter in English:<\/p>\n

Dear Ms. Alkalay, Dear Mr. Yordanov<\/p>\n

The\u00a0Bulgarian National Bank<\/b> has received a complaint filed under number 91TBT-0007\/09.08.2012 from\u00a0First Investment Bank<\/b> JSC,\u00a0Corporate Commercial Bank<\/b> JSC,Investbank<\/b> JSC, and\u00a0Central Cooperative Bank<\/b> JSC, which insists that the internet siteBivol<\/b> (www.bivol<\/b>.bg), owned by the company you represent, has published a series of articles, containing false information and circumstances, which undermined the reputation and credibility of each one of these\u00a0banks<\/b>. The claimants believe that with their actionsBivol<\/b> Ltd violate article 152A from the Credit Institutions Act and call for a probe and administrative sanctions.<\/p>\n

Because of the above, we wish to have a meeting between representatives of\u00a0Bivol<\/b> Ltd andBNB<\/b> to discuss the published materials and their possible effect on the stability of the country’s banking system when taking into account the nature of\u00a0banks<\/b>‘ activities. We propose to hold the meeting on October 11, 2012, at 2 pm in the\u00a0BNB<\/b> building, Bank Supervision Unit, at the following address: Sofia, 7 “Moskovska” street.<\/p>\n

Article 152a postulates that anyone who disseminates false information and circumstances about a bank, which undermines the bank’s reputation and credibility is sanctioned with a fine of BGN 2\u00a0000 to 5\u00a0000, and BGN 3\u00a0000 to 10\u00a0000 for repeat offenders. If the violation is committed through a mass media outlet, the fine ranges from BGN 5\u00a0000 to 10\u00a0000, and BGN 8\u00a0000 to 20\u00a0000 for repeat offenders.<\/p>\n

If the violator under paragraphs is a legal entity, a property sanction is imposed , ranging from BGN 10\u00a0000 all the way up to BGN 150\u00a0000.<\/p>\n
