Bulgarian lawyer Momchil Mondeshki, a protagonist in the infamous \u201cYaneva Gate\u201d recordings, has applied for a trademark with the same brand name with the exact Bulgarian spelling to be valid throughout the European Union, shows a publication<\/a> on the website of the European Intellectual Property Office.<\/p>\n

The application was filed on November 24, 2016, and was published on January 18. From the latter date on, there is a three-month deadline to object it.<\/p>\n

On November 1, 2016, Mondeshki gave an interview to Bulgarian Trud<\/em> (Labour) daily, linked to controversial lawmaker, businessman and media mogul, Delyan Peevski, and funded by First Investment Bank (FIB), in which he argued that the scandalous recordings had been staged by the participants in them \u2013 Mondeshki himself, the former President of the Sofia City Court (SCC), Vladimira Yaneva, and former SCC judge, Rumyana Chenalova, to discredit people at the top of the State, including Prime Minister, Boyko Borisov, Prosecutor General, Sotir Tsatsarov, the President of the Supreme Administrative Court, Georgi Kolev, and members of the Supreme Judicial Council (SJC). After this statement, which was strongly refuted by Chenalova, prosecutors renewed their probe into \u201cYaneva Gate\u201d.<\/p>\n

Mondeshka has applied for a “Yaneva Gate” trademark for a wide range of activities: \u201cstationery and educational supplies, gums [adhesives] for stationery or household purposes; printed matter; works of art and figurines of paper and cardboard, and architects’ models; filtering materials of paper; disposable paper products; paper and cardboard; telecommunication services; publishing and reporting; education, entertainment and sports; translation and interpretation\u201d.<\/p>\n

Mondeshki, becoming the owner of “Yaneva Gate”, means that he can demand, including from search engines, to delete all articles and links to them that contain that name. The lawyer has rushed the registration and has requested a speedy procedure, but has failed to pay on time, prompting a denial of such procedure. This is the reason why the application was published on January 18.<\/p>\n

Earlier, there was a successful attack on “Yaneva Gate” in Wikipedia. It turned out that the majority of the Bulgarian editors of this free encyclopedia share the views of the majority in the SJC and are zealously defending the model #WHO. Information about the scandal has been deleted despite the assessment of the European Commission and of Bulgarian politicians and human rights activists that it represents a significant legal and political case.<\/p>\n

The method of having a trademark for popular scandals was used by Peevski\u2019s mother, Irena Krasteva, in 2015 when she applied for a brand \u201cWHO\u201d, a word that has become a symbol of non-transparent and backstage rule. Her company “Press Market” filed an application for the registration of \u201cWHO\u201d in the Patent Office. However, the lawyers for the press group denied that they wanted to block the use of the word.<\/p>\n

Bivol will take measures to prevent an Orwellian deletion of evidence of abuse of power, malfeasance and conflict of interest by Boyko Borisov, Sotir Tsatsarov, Georgi Kolev and SJC members, Yassen Todorov, Dimitar Uzunov, judge Vladimira Yaneva and other persons in positions of power, mentioned in the recordings. We will engage lawyers to challenge Mondeshki\u2019s application and will soon announce a fundraising campaign.<\/p>\n

Mondeshki is tipped as one of the closest people around Delyan Peevski. There are also two court sentences against him. The first one is for document forgery in 2005 and the second is for large-scale embezzlement in 2006.
