{"id":44163,"date":"2018-12-29T01:37:24","date_gmt":"2018-12-28T23:37:24","guid":{"rendered":"https:\/\/bivol.bg\/?p=44163"},"modified":"2018-12-31T20:29:13","modified_gmt":"2018-12-31T18:29:13","slug":"sraelis-sue-bulgaria-in-washington-after-bulgarian-court-trustees-and-companies-linked-to-influential-politicians-ruin-their-business","status":"publish","type":"post","link":"https:\/\/bivol.bg\/en\/sraelis-sue-bulgaria-in-washington-after-bulgarian-court-trustees-and-companies-linked-to-influential-politicians-ruin-their-business.html","title":{"rendered":"Israelis Sue Bulgaria in Washington after Bulgarian Court, Trustees and Companies Linked to Influential Politicians Ruin Their Business"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The owners of Vitosha Resort 2000, Moti Ramot and Rami Levy,\nhave filed an <a href=\"https:\/\/icsid.worldbank.org\/en\/Pages\/cases\/casedetail.aspx?CaseNo=ARB%2F18%2F47&amp;fbclid=IwAR0bpYkHEMXJAUuEhH6JAvtbijLdHdXgo_wOAc777ZcEJSvxDbj3KvbUlqo\">arbitration\nclaim<\/a> against the Bulgarian State at the International Center for\nSettlement of Investment Disputes (ICSID), part of and funded by the World Bank\nGroup, headquartered in Washington, D.C., in the United States. The notice of\nregistration of a request for arbitration proceedings by the Acting\nSecretary-General for the institution had been published on December 27, 2018.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to unofficial information obtained by Bivol, the\nclaim is for over BGN 100 million. The Israeli investors had filed it against\nBulgaria after having alerted Bivol in an <a href=\"https:\/\/bivol.bg\/en\/court-trustee-and-company-of-who-organized-crime-group.html\">interview<\/a>\nas early as in 2016 that they had been the victim of a blatant attack by\ncompanies close to powerful people, and their business had been seized through\ndeliberate insolvency cases similar to those in the \u201cBelvedere\u201d scandal.<\/p>\n\n\n\n<figure class=\"wp-block-embed-youtube wp-block-embed is-type-video is-provider-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<span class=\"embed-youtube\" style=\"text-align:center; display: block;\"><iframe class=\"youtube-player\" width=\"1170\" height=\"659\" src=\"https:\/\/www.youtube.com\/embed\/cQZU0S3bSng?version=3&#038;rel=1&#038;showsearch=0&#038;showinfo=1&#038;iv_load_policy=1&#038;fs=1&#038;hl=en-US&#038;autohide=2&#038;wmode=transparent\" allowfullscreen=\"true\" style=\"border:0;\" sandbox=\"allow-scripts allow-same-origin allow-popups allow-presentation allow-popups-to-escape-sandbox\"><\/iframe><\/span>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The two Israelis acquired Vitosha Resort 2000 in 2007 and\ninvested through the company in a luxury residential development in the Sofia\nsuburb of Simeonovo, at the foot of Vitosha Mountain. They commissioned the\nconstruction to Ultrastroy. The development was built but Ultrastroy claimed\nadditional payment. Vitosha Resort 2000 refused on grounds of poor construction\nquality. Instead of having the dispute legally resolved under the law on\nbusiness claims, set out in the Civil Procedural Code, the builder initiated\nlow-cost bankruptcy proceedings against the investor Vitosha Resort 2000\/ case\n5019\/2013 on the docket of the Sofia City Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Court and trustees\n&#8220;finish&#8221; the investors<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the process, the court literally &#8220;finishes&#8221; the\nIsraelis by not recognizing their investment as a valid claim, but only\nallowing the claims of Ultrastroy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the request of Ultrastroy, <strong>Hristina Stamova<\/strong> has been appointed as trustee. Since the beginning\nof 2017, she began selling the apartments in the development for EUR 500-600\nper square meter, which was three times cheaper than the market prices in the\narea. Bivol&#8217;s check in the Property Register established that buyers of\napartments and garages in the development included companies close to the\nruling party Citizens for European Development of Bulgaria (GERB) and\nemblematic figures such as Mariyana, the wife of infamous businessman Mario\nNikolov and Hristina Stamova, herself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the same Hristina Stamova who was appointed\nconservator of the collapsed Corporate Commercial Bank (CCB) after its closure\nand after it was placed under special supervision before declaring it\nbankrupt.&nbsp;This is the time when the infamous loan assignments begun,\ncausing the melting of much of the outstanding loans. This enabled certain\ncompanies to \u201cclean up\u201d their long indebtedness to CCB and reduce the\ninsolvency mass. The former owner of the Bank, Tsvetan Vasilev, himself, said\nin TV interviews that the collapse of the lender was staged in typical gangster\nstyle through political means.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hristina Stamova was later transferred as conservator to the\nbank \u201cVictoria\u201d, which had been acquired by CCB shortly before its\ncollapse.&nbsp;Together with her colleague Bozhidar Arshinkov, Stamova was\naccused by employees of the Bank of syphoning it through shell consulting\ncompanies and lawyers (see&nbsp;<a href=\"https:\/\/bivol.bg\/en\/conservators-are-slowly-draining-victoria-commercial-bank.html\">here<\/a>).\nProtests demanding her replacement followed. Reports, published later, showed\nthat in six months Stamova and Arshinkov received a personal remuneration,\ndetermined by them, amounting to BGN 165,000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Sub-contractors of\nWHO?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ultrastroy Ltd. is a trading company whose sole owner is\nIvan Borisov Borisov, 43. Ultrastroy is a partner and subcontractor of the\nassociated with controversial lawmaker and media mogul Delian Peevski&nbsp; company\nVodstroy 98 in a number of major public procurement tenders. Ultrastroy has\nworked on the reconstruction of the south wing of the National Art Museum,\nknown as the Bulgarian Louvre. The company has also been a subcontractor in the\nrepairs at the Sofia Central Railway Station, where the main consortium has\nbeen between GLAVBOLGARSTROY and Vodstroy 98.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Outside public procurement, Ultrastroy is working on\nreconstruction and repairs of private sites related to tobacco manufacturer\nBulgartabac Holding, such as the factory for cigarette filters \u201cYuri Gagarin\u201d.\nIn a series of changes in ownership, the factory has passed from the\nState-owned \u201cBulgartabac\u201d to offshore companies associated with local\nhigh-ranking politicians. In several investigations, Bivol <a href=\"https:\/\/bivol.bg\/en?s=Bulgartabac+mafia\">explored<\/a> evidence of\ncorruption behind the privatization of Bulgartabac pointing to current Prime\nMinister Boyko Borisov and to Peevski. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ultrastroy is also indebted with BGN 8 million to the\nBulgarian Development Bank (BDB), but, at the same time, it has been chosen to\nbuild the Bank\u2019s new headquarters. Furthermore, the company is a partner in a\nconsortium which is tasked with the construction of the most expensive segment\nof the third line of the Sofia subway.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The on-paper owner of Ultrastroy, Ivan Borisov, told one of\nour reporters that he had been deceived by the Israelis as early as the moment\nof signing the contract. Apartment building #10 had been much larger than the rest\nof the buildings, and that is why at the last stage of the construction,\nBorisov had claimed an additional BGN 1 million, which had actually caused the\nconflict, according to him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ivan Borisov then explained the fact that his company is\ninvolved in some of the most significant construction works and public\nprocurement in the country together with companies associated with Peevski as \u201cnormal\nbusiness\u201d. He also said he did not know Delyan Peevski.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a curious coincidence that a company named Vitosha\nResort exists since 2017 and owns the emblematic Hotel &#8220;Berlin&#8221;,\nconsidered to be Peevski\u2019s leaving quarters. The former name of Vitosha Resort\nis Walton Associates-Eco. In 2010, Walton Associates-Eco sold to Balkan Media\nCompany of Irena Krasteva, who is Peevski&#8217;s mother, several apartments and the\ngarage in the hotel building.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But besides Peevsky&#8217;s corpulent shadow, the saga with the\nIsraelis brings to light a link to the circles close to Boyko Borisov. It\nemerges through the company Blick Trade to which Ultrastroy had assigned part\nof the claimed amount. Its manager is <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Samir Iskander\nFrancis (Ibrahim) \u2013 a partner of Borisov from the gangster years<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Iraqi national has been known in Bulgaria since the dark\nmafia times in the 1990s, when he was a partner of Bulgaria\u2019s current Prime\nMinister in their joint company Prayhim.&nbsp; A classified report of the\nNational Security Services (NSS) reveals that the case with the capture and\nkilling of Bulgarian truck drivers in Iraq is actually connected to outstanding\ndisputes over money from the traffic of amphetamines and Borisov had a direct\nbearing on the mafia affair, but at that time as Chief Secretary of the Interior\nMinistry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Later, Samir became a business partner of the infamous\ngangster Zlatomir \u201cThe Beret\u201d Ivanov.&nbsp;In March and August 1998, Samir\nFrancis registered two companies with Zlatomir Ivanov: \u201cNew Bingo\u201d and \u201cZ.E.S.\u201d\nin which he was manager.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bivol<\/strong> described these connections in its\ninvestigation&nbsp;\u201cBoyko Borisov \u2013 from the town of Cherven Bryag to Iraq\u201d.\nThe scandalous facts are confirmed in a classified diplomatic cable of the\nformer US Ambassador in Sofia, John Beyrle, (<a href=\"https:\/\/wikileaks.org\/plusd\/cables\/06SOFIA647_a.html\">here<\/a>) and the\nCongressional Quarterly article on the criminal past of Bulgaria\u2019s current\nPrime Minister, exposed by US journalist Jeff Stein (interview with Stein&nbsp;<a href=\"https:\/\/bivol.bg\/en\/stein-interview-part1-english.html\">here<\/a>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">People from powerful mafia circles tell stories about\nBorisov\u2019s exceptional trust in Samir, who has been his own personal driver and\nbodyguard before the start of the former political career.&nbsp;After Boyko\nBorisov became Mayor of Sofia, the business of the Iraqi as property developer\nflourished. He has earned millions through his companies \u201cStroy Commerce\n2004\u201d&nbsp;and<strong>&nbsp;\u201cBildko\u201d<\/strong>,&nbsp;beneficiaries of scandalous swaps\norchestrated by the Sofia Municipality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Apparently, Samir Iskander was not just anybody, because he\nhas also become son-in-law of General&nbsp;Stoimen Stoimenov, a former adviser\non security issues of former President Rosen Plevneliev. Stoimenov is as a\nformer functionary of the Central Committee of the Bulgarian Communist\nParty.&nbsp; The general\u2019s son-in-law and former partner of Borisov and\nZlatomir Ivanov has also had a joint company \u201cSIT-1\u201d Ltd. with notorious\nRussian mobster&nbsp;Konstantin Tziganov, head of the criminal group Uralmash,\nwho in 2011 was expelled from Bulgaria for being a threat to national\nsecurity.&nbsp;The Russian further became famous for his photos with Boyko\nBorisov at a charity soccer game.&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A\n&#8220;Belvedere&#8221; repeat<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So far, there is no information about the Israeli investors\u2019\narguments before the ICSID and whether they include claims that the Bulgarian\ncourt is influenced by powerful political and business connections, but the\ncourse of the case certainly raises doubts about a scheme in favor of\nUltrastroy and Blick Trade.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge, who has allowed hearings in the case and has\npresided over it, is <strong>Hayguhi Bodikyan<\/strong>,\nwhose name became known in the case \u201cBelvedere\u201d. In the course of the\nproceedings, judges and trustees have been replaced and dismissed; nevertheless\ntheir actions have remained irrevocable. Namely, trustee Veselin Vangelov has\nreported that there was a danger of property plundering (for the most part real\nestate with 24 hour security and video surveillance), and on these grounds has requested&nbsp; to declare the company insolvent. Judge\nBodikyan has seen this <strong>trustee report<\/strong>\nas a sound reason to announce the insolvency, preventing any possibility of\nrecovery. Moreover, the temporary trustee has immediately unlisted the company\nunder VAT, which has inflicted serious additional damage to the investors and\nproblems with the Bulgarian National Revenue Agency (NRA)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nonetheless, the most scandalous fact in this absurd court\nsaga is that <strong>the judges have refused to recognize\nthe rights and the expenses of the main creditors of Vitosha Resort 2000 &#8211; the\nIsraeli businessmen, but have ruled at the same time that their company is\nover-indebted because of their loans.
