{"id":44535,"date":"2019-01-10T12:35:48","date_gmt":"2019-01-10T09:35:48","guid":{"rendered":"https:\/\/bivol.bg\/?p=44535"},"modified":"2019-01-12T13:06:01","modified_gmt":"2019-01-12T11:06:01","slug":"not-pirates-but-corsairs-who-hijacked-libyan-tanker-badr","status":"publish","type":"post","link":"https:\/\/bivol.bg\/en\/not-pirates-but-corsairs-who-hijacked-libyan-tanker-badr.html","title":{"rendered":"Not Pirates But Corsairs: Who Hijacked Libyan Tanker BADR?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">An indicative mainstream media consensus is emerging alongside the scandal with the piracy hijacking of the Libyan tanker BADR &#8211; names and track records of the people behind the Bulgargeomin Ltd company are not mentioned for any reason. The main talking point is the fair recovery of an old Libyan debt to a respected Bulgarian firm. It is not even clear which company this is.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the reality is quite different, despite the efforts\nof, both, media and government actors to legitimize a <strong>non-legal entity<\/strong>. Because Bulgargeomin Ltd, which obtained the\ntanker with the help of a private law enforcement agent (PLEA) and despite the\nrulings of the Bulgarian Court, is precisely such a non-legal entity, not a\ncompany or a commercial association.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This legal statute is important, as evidenced by the ruling\nof the Supreme Court of Cassations, emphasizing that Bulgargeomin Ltd is <strong>ineligible<\/strong> and cannot be a claimant in\na &#8220;maritime claim&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Claimant&#8221; means any person claiming a maritime\nclaim, and &#8220;entity&#8221; means any natural or legal person or any public\nor private legal entity, the supreme judges &#8211; explain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court went further by commenting that &#8220;the use of a\ncompany name with two abbreviations, (Ltd and DZZD) not only creates the\ndelusion for the presence of a legal person within the meaning of Art. 63,\npara. 3, but also the use of the first abbreviated designation in a foreign\nlanguage only deepens the uncertainty about its type &#8211; whether it is a limited\nliability company, a joint stock company or even a limited partnership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In reality, in this veiled way some men playing it slick are\ntrying to represent themselves for what they are not. But who are they?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As Bivol revealed, the Swiss company Tectona Trading with\nshares of bearer represented by Andrea Caravelli and the offshore from the\nBritish Virgin Island Moran Trade &amp; Investment stood with equal shares behind\nBulgargeomin Ltd at its establishment on April 4, 2013, under the name\nConsortium BGM. Their Bulgarian avatars are Tectona with a capital of BGN 200,\nGlobe West Group 1 with the same capital, later renamed Moran West and Moran\nTrade with a capital of BGN 5,000. The contract for an association has been\nconcluded between these three companies, with Tectona having 50%, and Global\nWest Group and Moran Trade jointly owning the other 50%.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Just a few days after the establishment of Consortium BGM,\non April 11, 2013, the Sofia City Court gave the green light to this\nassociation to buy out the assets of the State-owned company Bulgargeomin,\nwhich had been bankrupt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On May 9, 2013, Consortium BGM was renamed with the\nmisleading name Bulgargeomin Ltd, and on May 16, 2013, it concluded a contract\nwith trustee Hristina Stamova, with which by direct negotiation (without\nauction) it acquired lucrative assets &#8211; properties abroad, receivables and\nother assets of the insolvent State-owned company.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The &#8220;Titans&#8221;\nand former State Security agents<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The price, and especially <strong>the origin of the funds<\/strong> for this acquisition, are a secret.\nHowever, it was been clear even then that <strong>Dimitar\nYosifov<\/strong>, one of the well-known owners of the waste disposal and management\ncompany Titan was behind Moran Trade and Investment. It was him who signed the\ncontract with the trustee Hristina Stamova. Tectona was represented by <strong>Kostadin Borisov Anakiev<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The next year, Bulgargeomin Ltd won <a href=\"https:\/\/contracts.bivol.bg\/?q=@(executant,executant_eik,executant_full)%20202297883\">two\npublic contracts<\/a> for a total of BGN 1.4 million from Sofiyska Voda (Sofia\nWater, the water utility company in the Bulgarian capital) and in 2015 it\ncarried out its first legal attack for the Bulgargeomin assets, which was\nagainst Bulgaria.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company used its misleading name to file a <a href=\"http:\/\/www.zimbabwelawreports.com\/law-reports\/bulgargeomin-ltd-v-government-of-the-republic-of-bulgaria-ors.html?fbclid=IwAR1BQ6gSbb2_E4i7DoZVxbCLJuyW0RvLZfScjoPWMR90-9z9KgMG-8eU5UE\">court\ncase in Zimbabwe<\/a> to acquire lucrative properties of the Bulgarian State, according\nto the ruling of the Supreme Court of Zimbabwe, available online.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This nasty attempt was unsuccessful. The fact that Bulgargeomin\nLtd had attempted to mislead the court in Harare that it had been a legal\nentity, the owner of two State properties for 33 years, is, however, outrageous.\nBut the activity of Bulgargeomin Ltd in Zimbabwe was not at all accidental and\nincidental.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Yet another economic domination\nof the State Security and of Cosa Nostra<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2013, a Bulgarian national, a partner of the Swiss man\nfrom Tectona appeared on stage in South Africa. This was amphetamine\n(captagone) trafficker Tsvetan Tsanev, who, together with Andrea Caravelli, the\nmanager of the Swiss Tectona Trade and with the German businessman Henri\nHenrion, had been negotiating with an Italian mafia boss for investment in a\ndiamond concession. This was revealed by the <a href=\"https:\/\/bivol.bg\/mafiaafrica.html\">investigation<\/a> \u201cMafia in Africa\u201d by\nthe Italian center for investigative journalism <a href=\"https:\/\/irpi.eu\/en\/mafia-in-africa\/\">IRPI<\/a>, in which Bivol also participated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Tsvetan&nbsp;Tsanev<\/strong>&nbsp;is well known in Bulgaria.\nThere is serious evidence that in his youth, during the time of the Communist\nregime, he had been involved in the trafficking of amphetamines through a German\ncompany through the Italian port of Bari.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 1991, the notorious captagone case was launched by the\nProsecutor General\u2019s Office. Tsvetan Tsanev was among the 21 defendants,\nincluding politicians, directors of State enterprises and former agents of the\nCommunist regime\u2019s special services \u2013 the State Security (DS). According to the\ncase, the captagone was produced to implement the program for the acquisition\nof foreign currency, masterminded by the Currency Committee of the Central\nCommittee of the Bulgarian Communist Party. The case was later closed because\nof important State interests, but the prosecutors had claimed at the time that\nUSD 1 billion a month had been taken out of the country through this so-called\n\u201chidden transit\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The close relationship of Tsvetan Tsanev, who is also a\nformer DS agent, with Tectona and Bulgargeomin Ltd, respectively, is also\nconfirmed by the fact that Kostadin Anakiev is a partner with Tsanev\u2019s wife\nVelichka and is the manager of the company BDZ Interservice of his father\nGeorgi Tsanev. But not just that.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>And a \u201cbad apple\u201d\nbanker<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another important link is the banker from Investbank <strong>Dimitriika Lazarova Andreeva<\/strong>. Shortly\nafter the association of Tectona and Moran in Bulgargeomin Ltd and the purchase\nof the assets of the State Bulgargeomin, she became Tectona&#8217;s manager and\nremained as such until March 2018.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We recall that the initial arrest of the BADR vessel over\nthe Bulgargeomin Ltd&#8217;s claim was in November 2017.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the time when Tsanev was the owner of the company Russpretroleum,\nits manager was <strong>Assen Kavdansky<\/strong>. It\nis he who appeared before notary Ioanna Andreadaki, along with Greek\nbusinessman Georgios Lappas, to prepare a maritime mortgage on the tanker BADR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the mortgage has not been signed as the parties\nhave failed to appear on the scheduled day. The draft, which has remained with\nLappas, has been forged later with Andreadaki&#8217;s signature and seal. An\napostille from the court in Athens has been placed on the counterfeit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fact that this is a counterfeit is proven by a graphology\ntest, published by <em>Maritime.bg<\/em>. Documents\non the site reveal that there is an investigation in Greece against Lappas and\nall persons involved in this criminal act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>State Security\nCorsairs<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The difference between a pirate and a corsair, for those who\nhave not read books on pirates, is that the pirates work at their own risk and\nat their own expense, while the corsairs work under the auspices of a State\nthat provides cover-ups to them and protects them if they mess up, explains one\nof our readers on Facebook in connection with the scandal with BADR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is precisely the case with Bulgargeomin Ltd, which is a\npure corsair. We are witnessing how an entity with an unclear legal status but\nwith distinct roots in the &#8220;deep state&#8221; of the criminal communist\nState Security is assisted and defended by the institutions of modern Bulgaria,\na European Union and NATO member, in carrying out an <a href=\"https:\/\/bivol.bg\/en\/pirate-raid-against-libian-tanker-in-bulgarian-bay.html\">unprecedented\ncriminal piracy<\/a> in the Black sea.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An
