{"id":44653,"date":"2019-01-14T18:24:54","date_gmt":"2019-01-14T16:24:54","guid":{"rendered":"https:\/\/bivol.bg\/?p=44653"},"modified":"2019-01-15T17:44:56","modified_gmt":"2019-01-15T15:44:56","slug":"scandalously-plowed-bulgarian-beach-dune-turns-out-to-be-cheap-farmland","status":"publish","type":"post","link":"https:\/\/bivol.bg\/en\/scandalously-plowed-bulgarian-beach-dune-turns-out-to-be-cheap-farmland.html","title":{"rendered":"Scandalously Plowed Bulgarian Beach Dune Turns Out To Be Cheap Farmland"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The price paid by Plamen Ivanov in 2000 for the beach property,\nwhich became notorious last weekend for being a dune illegally plowed by excavators,\nhad been BGN 16 for 1,000 square meters, reveals a check by Bivol in the Cadaster\nand the Property Register.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current owner of the plot on the Smokinya (Fig) beach, <strong>Ivan Nonchev<\/strong>, who was accused by the\nProsecutor&#8217;s Office of the destruction of the dune, has paid BGN 5,000 last\nyear for 683 square meters from the same property. The remaining 317 square\nmeters of the beach property are already exclusive State property. His deals, however, seem to be systematically carried out at\nunrealistically low prices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The status of the land has remained the same over the years\n&#8211; farmland, and the new owner Ivan Nonchev has placed a trailer on it.\nAccording to the Prosecutor&#8217;s Office, he ordered the destruction of the dune to\ntwo people, for which he paid BGN 1,000. He denies these claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bivol also explored the neighboring terrain, also located on\ndunes. Some of them are State-owned, but there are also those that are private\nand even have the status of land for construction. All this means that more scandals\nwith the dunes there are forthcoming.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Until an excavator\ndestroys them, or the State buys them out<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The expropriation of the dunes in favor of the State was promised\nyears ago by then-Minister of Regional Development, Lilyana Pavlov,a after a\nseries of scandals with their destruction by entrepreneurs close to the\ngovernment. The most notorious of them became known as <a href=\"https:\/\/bivol.bg\/en\/the-lessons-from-dunes-gate-one-year-later.html\">Dunes\nGate<\/a> six years ago, when Bivol proved that the Agriculture Ministry had\ngiven away the dunes at rock-bottom prices as farmland to businessmen close to\nthe country\u2019s rulers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Dunes Gate scheme is the brainchild of the <a href=\"https:\/\/bivol.bg\/en\/new-land-use-master-plan-entitles-bulgarian-politician-to-build-on-coast.html\">scandalous\narchitect<\/a> <strong>Kalin Tiholov<\/strong>, known\nto be close to &nbsp;<strong><a href=\"https:\/\/firstline.bivol.bg\/?q=%D0%BF%D1%80%D0%BE%D0%BB%D0%B5%D1%82%D0%B8%D0%BD%D0%B0+%D1%86%D0%BE%D0%BD%D0%B5%D0%B2%D0%B0\">Yordan\nTsonev<\/a><\/strong>, an influent lawmaker from the Movement for Rights and Freedoms\n(DPS, mostly representing the country\u2019s Muslim minority) and the party\u2019s\nLifetime Honorary Chairman Ahmed Dogan. Tsonev has participated in a number of other\nschemes for seizing valuable lands along the coast and in particular in the\nNature Park in the Strandja Mountain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The outcome of the Dunes Gate scandal was the adoption of a\nlaw that requires the dunes to be mapped and indicated on special cadastral\nmaps and then to be turned into a State property. Six years later, the special\nmaps are not yet entirely ready and no expropriation procedures had been\ncarried out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Meanwhile, almost every year there is a new scandal with\ndestroyed dunes, as the owners are in a hurry to plane them down, build on them\nand to present the State with a fait accompli. For its part, the government is\nin no hurry to stop them, and <a href=\"https:\/\/bivol.bg\/en\/duni-strah-english.html\">even helps them<\/a> with its\ninaction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was the case with the dunes on the beach camping site\n&#8220;<a href=\"https:\/\/bivol.bg\/en\/concrete-is-poured-on-the-coast-of-camping-site-south-the-ministry-of-regional-development-and-public-works-is-hiding-dunes-maps.html\">South<\/a>&#8220;,\nin the northern part of the \u201cCoral\u201d beach, where a hotel was built. In theory,\nthe State National Construction Control should have already started a demolition\nprocedure, but there has not been and there isn\u2019t such a move.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a similar tolerance by the State in the case with\nthe outrageous Mafia hotel \u201cDune\u201d, built directly on the beach in the \u201cSunny\nBeach\u201d resort.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What should the State\nurgently do?!<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The coalition of non-profit organizations and civil groups\n&#8220;<strong>For the Nature in Bulgaria<\/strong>&#8221;\nwarns that the latest plowing and destruction of dunes is a serious violation\nof the legislation and shows the <strong>State&#8217;s\nincapability to preserve nature<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The natural landmark has been declared as such by an order\nas early as 1984 to preserve the habitats of rare species. Accordingly, it\nprohibits activities that damage or alter both the natural appearance of the\nsite and its water regime, as well as any construction, the entry of motor\nvehicles, the rooting or picking of plants, etc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An inspection by the eco activists shows that a large part\nof the gray dunes in the natural landmark near the camping site &#8220;Smokinya&#8221;\nis private property and listed as farmland. <strong>But even in the case of private ownership, under the Biodiversity Act, the\nowner is cannot destroy species that could be found on plowed dunes.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Therefore:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; All dunes should be included in Zone A under the Black Sea\nCoast Planning Act;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&#8211; All dunes on the cadastral map should be listed as\nsuch and not as vineyards, farmland or pastures as is currently the case;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;<strong>&#8211; All illegally-swapped\nfarmlands (as is most likely the case of the Smokinya dunes) and forests for\nwhich there is a final decision at the level of the European Union that has not\nbeen implemented by the Bulgarian government, should be returned to the State<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&#8211; The State to fulfill its obligation under the <strong>Black Sea Coast Planning Act<\/strong> and to\nexpropriate all privatized or restituted dunes, most of which are farmland.\nThere are funds for this in the Operational Program &#8220;Environment\n2014-2020&#8221;;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8211; All movable objects\nplaced on the dunes should be removed;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&#8211; Destroyed and damaged dunes must be recovered under\nthe Environmental Liability and Environmental Damage Liability Act (LOD).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The price paid by Plamen Ivanov in 2000 for the beach property, which became notorious last weekend for being a dune illegally plowed by excavators, had been BGN 16 for&hellip;<\/p>\n","protected":false},"author":1,"featured_media":26632,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"give_campaign_id":0,"_crdt_document":"","_relevanssi_hide_post":"","_relevanssi_hide_content":"","_relevanssi_pin_for_all":"","_relevanssi_pin_keywords":"","_relevanssi_unpin_keywords":"","_relevanssi_related_keywords":"","_relevanssi_related_include_ids":"","_relevanssi_related_exclude_ids":"","_relevanssi_related_no_append":"","_relevanssi_related_not_related":"","_relevanssi_related_posts":"","_relevanssi_noindex_reason":"","rop_custom_images_group":[],"rop_custom_messages_group":[],"rop_publish_now":"initial","rop_publish_now_accounts":[],"rop_publish_now_history":[],"rop_publish_now_status":"pending","kia_subtitle":"","_lmt_disableupdate":"","_lmt_disable":"","_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2},"_wpas_customize_per_network":false,"jetpack_post_was_ever_published":false},"categories":[5805],"tags":[5148,4965],"class_list":["post-44653","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-leading","tag-dunes","tag-dunes-gate"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v26.6 (Yoast SEO v27.4) -
