{"id":45346,"date":"2019-02-05T10:21:19","date_gmt":"2019-02-05T08:21:19","guid":{"rendered":"https:\/\/bivol.bg\/?p=45346"},"modified":"2019-02-07T16:40:04","modified_gmt":"2019-02-07T14:40:04","slug":"bulgarian-prosecution-launders-fraud-for-eur-200-m-with-expired-statute-of-limitations","status":"publish","type":"post","link":"https:\/\/bivol.bg\/en\/bulgarian-prosecution-launders-fraud-for-eur-200-m-with-expired-statute-of-limitations.html","title":{"rendered":"Bulgarian Prosecution \u2018Launders\u2019 Fraud for EUR 200 M with Expired Statute of Limitations"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The prominent businesswoman <strong><a href=\"https:\/\/bivol.bg\/en?s=Ginka+Varbakova\">Ginka Varbakova<\/a><\/strong>\nhas indeed presented to the Bulgarian Energy and Water Regulatory Commission (<a href=\"http:\/\/www.dker.bg\/en\/home\">EWRC<\/a>) <strong>a fake bank guarantee<\/strong> for EUR 200 million to obtain a license for\nthe \u201cReal States\u201d company to produce electricity. However, the guarantee is a\nprivate document and the statute of limitations for its unlawful use is five\nyears and it has expired. For this reason, on December 10, 2018, the Sofia City\nProsecutor\u2019s Office terminated the case on the signal by Bivol.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, Ginka Varbakova and the company had not\nobtained any profit from the issuance of the license, according to prosecutor\nM. Dimitrova. On these grounds, she rejects the &#8220;document fraud&#8221; premise\nunder Art. 212, mentioned in signal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Interestingly, the Prosecutor&#8217;s Office has closed the case\nwithout even waiting for a response from the United Kingdom under a legal\nassistance request to determine whether DEANFIELD SOLUTIONS is a bank or not.\nThere is no official data about such a banking institution. The company itself\nis dormant, while among its managers one can find the name of <strong>Roberto Pontiggia<\/strong>, who has been arrested\nin Italy for financial fraud at the request of that same Bulgarian Prosecutor&#8217;s\nOffice, as an earlier <a href=\"https:\/\/bivol.bg\/en\/company-associated-with-well-known-names-gave-28-million-to-bulgarian-buyer-of-cez.html\">investigation<\/a>\nby Bivol revealed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Let\u2019s not unearth it\nbecause it will reek<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, it has been firmly established that it was precisely\nGinka Varbakova who has represented the \u201cReal States\u201d company, which is\nofficially registered to her mother Petrana Paytakova. Thus, on August 23, 2010, the\nEWRC issued to the \u201cReal States\u201d EOOD license #L-336-01 for the production of\nelectricity, valid for 25 years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the fraudulent license had not been used, the\nProsecution Office further establishes. \u201cReal States\u201d actually sold electricity\nat preferential prices to the EVN electric power utility, but only from a 2.45\nMW facility (instead of the stated 60 MW). As there is no need of an\nelectricity production license for power plants below 5MW, accordingly, there\nhas been no direct profit for the company from the license obtained through the\nfake bank guarantee, the prosecution concludes. In 2015, \u201cReal States\u201d has\nrequested and obtained from the EWRC the suspension of the license as the\nconditions for buying at preferential prices have changed and were no longer so\nprofitable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The EWRC\u2019s work on issuing and terminating the license on the\ngrounds of a fake document is not considered a damage and the bill has been\nfooted by the taxpayers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Eventually, the case was crushed without a formal response\nfrom the United Kingdom and without even questioning the former company manager\nRoberto Pontiggia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This rush to close the case obviously benefits Ginka\nVarbakova as the disclosure of the fake guarantee is a serious reputational\ndamage to the government\u2019s darling \u2013 the businesswoman from Pazardzhik, who is\na candidate to buy the Bulgarian assets of the State-owned Czech electric power\nutility, CEZ.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, once again, the prosecution has proven that its priority is not to clarify all the facts and circumstances surrounding a large-scale <g class=\"gr_ gr_5 gr-alert gr_gramm gr_inline_cards gr_disable_anim_appear Punctuation only-del replaceWithoutSep\" id=\"5\" data-gr-id=\"5\">swindle,<\/g> but to blur an affair involving a person close to those in power. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Or as the prominent Bulgarian poet Nikola Vaptsarov once wrote: \u201cWhen <a
