{"id":45430,"date":"2019-02-07T17:40:09","date_gmt":"2019-02-07T14:40:09","guid":{"rendered":"https:\/\/bivol.bg\/?p=45430"},"modified":"2019-02-09T12:05:12","modified_gmt":"2019-02-09T10:05:12","slug":"bulgarian-banks-accounts-to-be-frozen-again-over-eur-22-m-fraud-in-romania","status":"publish","type":"post","link":"https:\/\/bivol.bg\/en\/bulgarian-banks-accounts-to-be-frozen-again-over-eur-22-m-fraud-in-romania.html","title":{"rendered":"Bulgarian Bank\u2019s Accounts to Be Frozen Again over EUR 22 M Fraud in Romania"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A private law enforcement agent (PLEA) is once again\nrequesting a freeze on the accounts of the Bulgarian <strong>First Investment<\/strong> <strong>Bank<\/strong>\n(FIB or Fibank) once the lender lost its case in the Supreme Court of\nCassations (SCC). Per the Court\u2019s final rule, FIB must transfer to the Romanian\nMinistry of Agriculture a EUR 22 million bank guarantee that it owes as\ncollateral in a deal with food deliveries for Romania\u2019s poor people. The deal\nis notoriously known as the biggest one-time theft of European Union (EU)\nfunds, conducted with the complicity of the Bank.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On January 28, 2019, the SCC issued its <a href=\"http:\/\/domino.vks.bg\/bcap\/scc\/webdata.nsf\/Keywords\/AF8C2F954FC49D06C22583900043BF5B\">decision 340<\/a>, rejecting FIB&#8217;s claims against an enforcement action by the Ministry of Agriculture of Romania, confirmed by the Sofia Court of Appeals in 2016. The previous freeze of FIB&#8217;s accounts took place at the end of 2016, but the Bank managed to stop the enforcement by appealing with the SCC. Now, FIB&#8217;s last chance is to overturn the very cause for the case in the Bucharest court, where the hearing is scheduled for Monday, February 11.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/i1.wp.com\/bivol.bg\/wp-content\/uploads\/2019\/02\/chsi-fibank-apia.png?fit=1024%2C865&amp;ssl=1\" alt=\"\" class=\"wp-image-45352\" width=\"344\" height=\"291\" srcset=\"https:\/\/bivol.bg\/wp-content\/uploads\/2019\/02\/chsi-fibank-apia.png 1524w, https:\/\/bivol.bg\/wp-content\/uploads\/2019\/02\/chsi-fibank-apia-300x254.png 300w, https:\/\/bivol.bg\/wp-content\/uploads\/2019\/02\/chsi-fibank-apia-768x649.png 768w, https:\/\/bivol.bg\/wp-content\/uploads\/2019\/02\/chsi-fibank-apia-1024x865.png 1024w, https:\/\/bivol.bg\/wp-content\/uploads\/2019\/02\/chsi-fibank-apia-1170x989.png 1170w, https:\/\/bivol.bg\/wp-content\/uploads\/2019\/02\/chsi-fibank-apia-585x494.png 585w\" sizes=\"(max-width: 344px) 100vw, 344px\" \/><figcaption> <br \/>A PLEA has resumed the enforcement proceedings against FIB <\/figcaption><\/figure><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">However, the chance that the guarantee will be dropped is\nnot that big, according to the case\u2019s documents, which Bivol has examined. Our\nsite has been following for years this scandal which OLAF and the Romanian\nAnti-Corruption Prosecution Office are also investigating.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bivol sent a question to the central bank, (the Bulgarian National Bank, BNB), asking whether it would confirm or refute the information about the freeze on FIB&#8217;s accounts. The following terse comment was received from the BNB\u2019s press office, which does not refute the information:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201cJudicial proceedings\nprogress in accordance with the established procedural order and information on\ntheir development is available only to the parties in the specific case. The\nBNB implements court decisions in so far as they pertain to it.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>The specific\ninformation you require from the BNB is not public information, and the facts and\ncircumstances concerning accounts\u2019 and deposits\u2019 balances and transactions are\nbank secrets under Art. 62 of the Credit Institutions Act.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The office of private enforcement agent Ulyana Dimolarova\ndid not respond to the request for comment on the stage of the enforcement\nproceedings in case 20168580401364, which had been resumed on January 31, 2019.\nThe Romanian side\u2019s lawyer, Milcho Bengarski, did not answer his phone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>When there is no oil<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Everything started in 2012, when the Bulgarian company\n&#8220;VM Corporation&#8221; won a public tender for the supply of flour and cooking\noil for the poor in Romania. The money\ndisappeared in offshore accounts, and ever since then APIA and FIB have been\nleading court battles for the guarantees. It seems now that the saga has\nreached its final stretch. The SCC ruled that the claim against FIB is valid\nand the rule is final.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Beyond the court battles, however, there is a twisted\ncriminal story that is also evidence of a serious deficit in the system for\nprotecting European funds from theft.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">OLAF and the Romanian National Anticorruption Prosecution\nOffice (DNA), now the National Anticorruption Directorate, are the bodies\nengaged in the unraveling of the affair. Their investigation established that\nthe masterminds of the scheme include Bulgarian nationals Ivan &#8220;The\nUniversal&#8221; Tanev and Mila &#8220;The Bloody Mila&#8221; Georgieva from \u201cThe\nKillers\u201d gang along with several other helpers. However, the indictment explicitly\nstates that the scheme has been implemented with FIB&#8217;s complicity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A destitute individual with a bank guarantee for EUR 33 million<\/strong> On paper, the owner of the company is the impoverished Bulgarian citizen <strong>Valeri Miloradov Petrov<\/strong>. Bivol was able to find him and he told us in a camera-recorded interview how he has worked as a professional &#8220;strawman&#8221; for different companies. In a lengthy videoconference interview, he categorically denied any\ninvolvement in the scheme and blamed FIB and Mila Georgieva\u2019s gang for the\ntheft.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Where is the money?\nWith &#8220;The Killers&#8221;!<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">OLAF and the DNA have established that money has been stolen\nthrough accounts in Cyprus in the Bank of Cyprus and two offshores on the Seychelles\nand the British Virgin Islands. The tracks led to companies in Hong Kong, where,\nhowever, the investigators hit a wall.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/bivol.bg\/wp-content\/uploads\/2015\/11\/apia_bulgari_005_v2.jpg\" alt=\"\" class=\"wp-image-28433\" width=\"265\" height=\"305\" srcset=\"https:\/\/bivol.bg\/wp-content\/uploads\/2015\/11\/apia_bulgari_005_v2.jpg 695w, https:\/\/bivol.bg\/wp-content\/uploads\/2015\/11\/apia_bulgari_005_v2-261x300.jpg 261w\" sizes=\"(max-width: 265px) 100vw, 265px\" \/><figcaption> <br \/>The money trail, according to Romanian prosecutors <\/figcaption><\/figure><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">However, Bivol\u2019s investigation went further and traced part\nof the money back to Bulgaria, where it has been used to buy a pellet factory and\nreal estate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This became possible after we managed to convince Valeri\nMiloradov to cooperate. He gave a power of attorney to our reporter Dimitar\nStoyanov, who traveled to Cyprus. At the Bank of Cyprus, he learned that the\naccounts of VM Corporation had been closed by lawyer <strong>Orestis Shambartas<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same lawyer also emerged as the owner of one of Hong\nKong&#8217;s companies &#8211; <strong>Sun Power Industrial<\/strong>,\nto which part of APIA&#8217;s money has been wired. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But for whom did Shambartas work? He refused to disclose his\nclient before Bivol but said that all his actions had been completely legal and\nhe would provide information only to law enforcement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Subsequently, a joint investigation by Bivol, Rise Romania\nand the Hungarian center for investigative journalism Atlastzo revealed that\nSun Power Industrial had an offshore bank account in the St. Vincent and\nGrenadine Islands. The leak, known as The Panama Papers, brought to light the\nowner of that bank \u2013 Hungarian entrepreneur <strong>Otto Hujber<\/strong>, who has a reputation of a \u201cbusinessman\u201d associated\nwith the Hungarian Socialist Party in the early years of the transition period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The money from <strong>Sun\nPower Industrial<\/strong>&#8216;s offshore account has been used by the Bulgarian thugs\nfrom \u201cThe Killers\u201d gang &#8211; <strong>Georgi \u201cThe\nTennis\u201d Bozhilov and Ivaylo \u201cThe Tennis\u201d Bozhilov<\/strong> and Mila Georgieva. The company has bought with this money a pellet factory and\nexpensive real estate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But most of the APIA&#8217;s millions have sunk into another\noffshore company &#8211; <strong>Grand Ocean Services<\/strong>.\nIt is represented by <strong>Ivan Karatsanov<\/strong>,\nto whom FIB has issued a bank reference letter #11-7017. As Bivol wrote,\nRomanian investigators have already <a href=\"https:\/\/bivol.bg\/en\/organized-crime-group-connected-with-the-killers-and-with-first-investment-bank-launders-money-from-drug-trafficking.html\">requested<\/a>\ndocuments in connection with this letter, which usually serves to open a bank\naccount abroad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Meanwhile, <strong>Karatsanov\nis also a proxy of VM Corporation<\/strong> &#8211; the company of the destitute Valeri\nMiloradov Petrov that robbed the Romanian poor. Thus the circle closes. It\nturns out that <strong>the Bank knew very well\nwho controls Grand Ocean Services and how it is related to VM Corporation<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, the <a href=\"https:\/\/bivol.bg\/en\/private-lenders-majority-shareholder-in-joint-deal-with-criminal-gang.html\">property\nrelationship<\/a> between Mila Georgieva and one of the owners of FIB, Ivaylo\nMutafchiev, about which Bivol wrote in 2015, is also a fact.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Threats and media\nattacks against journalists of Bivol<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The shedding of light on the affair with the millions stolen\nfrom the APIA provoked a sharp reaction. Bivol\u2019s reporter Dimitar Stoyanov, who\nvideotaped Valeri Petrov&#8217;s confession, was tailed by thugs. Then the\nmercenaries of Channel 3 TV of controversial lawmaker and media magnate Delyan Peevski\ntravelled all the way to Paris to harass Bivol\u2019s editor-in-chief Atanas Tchobanov.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There was a remarkable <a href=\"https:\/\/bivol.bg\/en\/stefka-stoeva-is-the-cause-of-peevskis-attack-on-bivol.html\">statement<\/a>\nby one of the directors of Channel 3 TV as she explained in an interview for\nbTV that they had been investigating Bivol\u2019s journalists because Bivol\u2019s\njournalists had been investigating individuals associated with the APIA affair.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, Peevski&#8217;s mercenaries &#8211; Channel 3 TV &#8211; a major\nborrower from FIB and a guarantor of the impunity of its majority shareholders,\n<strong>Tseko Minev<\/strong> and <strong>Ivaylo Mutafchiev<\/strong>, practically admitted that they had been activated\nprecisely because of this particular investigation by Bivol.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Denouement?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It seems that after seven years of lawsuits and a complicated\ncross-border criminal investigation, things are finally moving towards a conclusion.\nThe Romanians are on the verge of their first significant success &#8211; the\nrecovery of the money from the guarantee. In addition, APIA bosses, who had\nsigned under the payments to the phantom Bulgarian company were arrested and\nindicted in Bucharest. No one has been charged in Bulgaria so far, and the\nBulgarian Prosecutor&#8217;s Office has not undertaken any activity in connection\nwith the affair.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case, however, revealed to what extent EU and Bulgarian anti-fraud\nand anti-organized crime authorities are powerless and &#8220;fictional\nheroes&#8221;, as Valeri Miloradov calls them. It sounds incredible, but it is a\nfact &#8211; in the 21st century, tens of millions of euros from the European budget can\ndisappear without a trace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For seven years, European and national institutions have\nbeen unable to trace the stolen millions, despite their huge operational\ncapacity. Even the Romanian DNA has failed to get as far on the money trail as the\ninvestigative journalists of Bivol, Rise Romania and Atlastzo did.
