The Athens Court of First Instance ruled on January 30,\n2019, a precautionary measure prohibiting the use of the maritime mortgage for\nthe BADR tanker. The measure is at the request of the Libyan company owner of\nthe tanker as it claims that the mortgage has been forged. The same is claimed\nby notary Ioanna Andreadaki in a complaint to the Greek Prosecutor’s Office\nwhose investigation is ongoing. Meanwhile, it became known that the license of private\nlaw enforcement agent (PLEA) Totko Kolev, who organized the hijacking of BADR,\nhad been revoked by the Disciplinary Committee of the Chamber of Private\nEnforcement Agents at the request of the Bulgarian Justice Minister for gross\nviolations of the law, nevertheless, the government continues to keep silent\nand who knows why it is not boasting about this initiative. Totko Kolev is\nappealing the decision.<\/p>\n\n\n\n

All ownership claims of \u201cBulgargeomin\u201d Ltd, behind which are\ncompanies associated with the scandalous lawyer Tsvetan Tsanev<\/strong> and the waste management company \u201cTitan\u201d, are based\non a EUR-9 million maritime mortgage issued in Athens, bearing the signature\nand the seal of notary Ioanna Andreadaki. However, this mortgage is forged,\nAndreadaki insists.<\/p>\n\n\n\n

Bivol talked on the phone with notary Andreadaki and\npublished her\nconfirmation<\/a> as early as December 31, 2018, a few days after the tanker was\nbrutally hijacked by Bulgargeomin\u2019s thugs. It became clear later that the\nBulgarian Prosecutor’s Office has been working on the fake mortgage case since\nJuly but has not issued any precautionary measures to prevent the use of the\nfake document for property dispositions.<\/p>\n\n\n\n

And now, the decision of the Court in Athens that this\nmortgage cannot be used as a trustworthy document is a fact.<\/p>\n\n\n\n

Bivol has documents from which it is clear that besides the\nfake mortgage, \u201cBulgargeomin\u201d Ltd has provided entirely fake documents to \u201cMaritime\nAdministration\u201d to release the ship from arrest. All security certificates, as well as the temporary Panamanian\nNavigation License, number 000265462, have been forged.<\/strong><\/p>\n\n\n\n

After it became clear that The Panama Maritime Authority had\nlaunched a procedure to withdraw the flag of BADR over a complaint by the legitimate Libyan owner, the new\nillegal owners of BADR ordered the tanker to weigh anchor and flee to Odessa.\nAs in a scene like from a movie, the ship was pursued by a border police cutter\nbecause it refused to obey orders to return to the Burgas Bay.<\/p>\n\n\n\n

Ministry of the Interior\ncontinues to keep silent about the pirate attack involving its employees<\/strong><\/p>\n\n\n\n

By the end of 2018, Bivol first published<\/a> the certified\ntestimonies of the captain and the crew about exactly what happened on December\n21 in the Burgas Bay. All testimonies firmly point to an armed attack by\ngovernment officers and private security guards from the unlicensed company \u201cBashev\nTeam & Security<\/a>\u201d, who abused and humiliated the sailors on board BADR,\nforced the legitimate crew to leave the vessel, and replaced it with another one\nunder the command of a Ukrainian captain.<\/p>\n\n\n\n

In addition, Bivol provided\nevidence<\/a> that active police officers had served as private security guards of\n\u201cBashev Team & Security\u201d in violation of the Ministry of the Interior Act.  Bivol revealed that Alexander Vassilev Longochev<\/strong> (on the headline photo), a policeman\nfrom the special police task force in the Bulgarian capital (SPS-Sofia), had\nboarded BADR in a uniform of \u201cBashev Team & Security\u201d. He has been\nidentified by Captain Abdullah Abdul\nJalil<\/strong> as one of the people who hijacked the tanker on December 21, 2018.<\/p>\n\n\n\n

License of PLEA Totko\nKolev secretly revoked<\/strong><\/p>\n\n\n\n

In Bulgaria, the actions for the appropriation of the ship\nhave been led by PLEA Totko Kolev, as it turns out, absolutely illicitly. After\nforeclosing the tanker, he has handed out an invitation for voluntary execution\nand, subsequently, a summons for a forced execution to the ship agent \u201cWhite\nGroup\u201d, with which, however, \u201cLibyan Navigator\u201d Ltd. has no relationship. Thus,\nthe real owner has been unaware of what has been happening and has been unable\nto defend itself against the forced inventory of the tanker, which was done on\nFebruary 8, 2018 at 11 am. Furthermore, Totko Kolev has ignored the suspension\nof the forced execution by the Burgas Regional Court in a rule from February 6,\n2018. Kolev’s next violation is that he has concluded the public sale of the\ntanker one day before the deadline, while part of the sale documentation is\nmissing. The imperative provision under the law for notifying the National\nRevenue Agency has been violated as well. To top it all, the documentation is\nmissing signatures and has not been filed as required by the law.<\/p>\n\n\n\n

All these actions show that Totko Kolev has acted as a kamikaze\nwith the sole motivation to conclude the appropriation of the tanker in favor\nof Bulgargeomin. The Disciplinary Committee of the Chamber of Private\nEnforcement Agents had imposed the heftiest disciplinary sanction \u2013 revocation of\nhis PLEA License as early as November 19, 2018. This, however, had not prevented\nTotko Kolev from continuing with the execution actions and in the last days of\n2018, he organized the hijacking of the tanker and the removal of his crew with\nthe assistance of thugs, the border police and the staff of \u201cMaritime\nAdministration\u201d.<\/p>\n\n\n\n

After all the exploits of PLEA Totko Kolev, which led to an\ninternational scandal over the hijacking, the government has not said a word about the disciplinary proceedings\ninitiated by Justice Minister Tsetska Tsacheva<\/strong>. Its official position was\nand remains that it is a civil legal dispute, to which the synchronized actions\nof the Ministry of the Interior, the PLEA and \u201cMaritime Administration\u201d in\nfavor of Bulgargeomin have no relation. The documents, however, prove that the\nState institutions had been very well aware of the committed outrages, and, at\nleast formally, had launched a probe which is dragging along.<\/p>\n\n\n\n

On January 28, 2018, Tsacheva sent a second request for a\ndisciplinary action to the Disciplinary Committee of the Chamber of Private\nEnforcement Agents. She asked for PLEA Totko Kolev to be temporarily removed\nfrom office until the end of the previous disciplinary proceedings. The decision\nof the Committee is forthcoming. Currently, Totko Kolev is also in the\ncrosshairs of the Burgas Regional Prosecutor’s Office, which has charged him\nfor old sins and is probing him for offenses related to the tanker.<\/p>\n\n\n\n

Who is Tsvetan\nTsanev?<\/strong><\/p>\n\n\n\n

In just a few months, Tsvetan Tsanev emerged behind two huge\ninternational scandals that caused serious reputational damage to Bulgaria –\nthe hijacking of BADR and the laundering of tens of millions of dollars of the\nregime of embattled Venezuelan President Nicolas Maduro through Tsanev\u2019s\naccount in Investbank.<\/p>\n\n\n\n

The lawyer (Tsanev) with German citizenship who is living in\nSwitzerland also appeared in an investigation by Bivol from 2015, in\npartnership with Italian colleagues from IRPI<\/a>\/ANCIR<\/a> entitled \u201cMafia in\nAfrica\u201d. The investigation<\/a> established\non the basis of documents that Tsanev and two other persons had negotiated with\nItalian mafia boss Antonino Messicati Vitale<\/strong> to join as\n\u201cEuropean investors\u201d in a criminal affair with South African diamonds. <\/p>\n\n\n\n

There is serious evidence that in his youth, during the time\nof the Communist regime, he had been involved in the trafficking of\namphetamines (captagone) through a German company through the Italian port of\nBari. <\/p>\n\n\n\n

In the early 1990s, he was charged with captagone trafficking\nduring the time of the regime, when he has also been an agent of the Communist\nsecret services \u2013 the State Security.<\/p>\n\n\n\n

In the past, Tsanev has had close\nbusiness connections<\/a> with people from the so-called \u201cBankya Circle\u201d over\noil business with Russia. One of these individuals is Dimitar Sabev<\/strong>,\nwhose relative Nedyalko Nedyalkov<\/strong> is a Deputy Head of\nBulgaria\u2019s National Security Agency (DANS<\/strong>)\n\u2013 the institution tasked with detecting cases of money laundering. <\/p>\n\n\n\n

In more recent times, Tsanev and his wife have built\nbusiness relations with the management of Investbank and the Omani investor in\nit – Sheikh Adel Said al-Shanfari.<\/p>\n","protected":false},"excerpt":{"rendered":"
