{"id":45894,"date":"2019-03-06T14:55:25","date_gmt":"2019-03-06T11:55:25","guid":{"rendered":"https:\/\/bivol.bg\/?p=45894"},"modified":"2019-03-07T11:27:56","modified_gmt":"2019-03-07T09:27:56","slug":"greek-police-detain-businessman-over-forged-badr-mortgage","status":"publish","type":"post","link":"https:\/\/bivol.bg\/en\/greek-police-detain-businessman-over-forged-badr-mortgage.html","title":{"rendered":"Greek Police Detain Businessman over Forged BADR Mortgage"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Greek police arrested on March 5 (Tuesday) <strong>Georgios Lappas<\/strong>, who, according to\nnotary Ioanna Andreadaki, had organized the forgery of a maritime mortgage on\nthe tanker BADR in favor of Bulgargeomin.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The detention was made under a European arrest warrant (EAW)\nissued by the Bulgarian Prosecutor&#8217;s Office in early 2018, the Greek newspaper <a href=\"https:\/\/www.tovima.gr\/2019\/03\/05\/society\/synelifthi-ellinas-mesazon-stin-ypothesi-metaforas-kefalaion-apo-venezouela-se-voulgaria\/\"><em>\u03a4\u03bf \u0392\u03ae\u03bc\u03b1<\/em><\/a><em> (To Vima<\/em>) reports, citing a Greek police statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that the Bulgarian Public Prosecutor&#8217;s Office has\nknown all details, but has kept silent on this case, even after the illegitimate\noccupation of BADR through fake documents ensnarled Bulgaria into an\ninternational scandal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The claimant for the ownership of the tanker is Bulgargeomin\nLtd, which presents itself as the successor of the State-owned company with the\nsame name, but has nothing to do with it. All actions of Bulgargeomin before\nthe Bulgarian courts and private enforcement agents, in their attempt to obtain\nthe tanker, are based on this proven to be counterfeit document.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On December 22, 2018, the tanker was literally hijacked by\narmed guards of the unlicensed company \u201c<a href=\"https:\/\/bivol.bg\/en\/special-task-force-policeman-leads-hijacking-of-badr-tanker.html\">Bashev\nTeam &amp; Security<\/a>\u201d that also included active police officers dressed in\nthe uniform of the company. This modern day piracy led to an international\nscandal and a vehement diplomatic reaction by Libya. The armed capture of the\nLibyan tanker by the Bulgarian authorities in the Burgas Bay was listed in\nreports by the&nbsp;<a href=\"https:\/\/www.oni.navy.mil\/Portals\/12\/Intel%20agencies\/piracy\/20190102_WTS.pdf?ver=2019-01-04-071255-140\">US\nOffice of Naval Intelligence as<\/a>&nbsp;a pirate attack.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of stopping this apparently criminal act, the\nprosecution remained inactive. State institutions even expressed support for\nthe \u201cpirates\u201d, declaring their criminal scheme a &#8220;civil legal&#8221;\ndispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bivol <a href=\"https:\/\/bivol.bg\/en\/pirate-raid-against-libian-tanker-in-bulgarian-bay.html\">talked\non the phone<\/a> with notary Andreadaki as early as the end of 2018, and she\nconfirmed her written complaint to the Greek Prosecutor&#8217;s Office describing how\nthe fake marine mortgage had been fabricated. She also referred to the results\nof an <a href=\"https:\/\/bivol.bg\/en\/not-pirates-but-corsairs-who-hijacked-libyan-tanker-badr.html\">expert\nreport<\/a> proving that her signature and seal had been falsified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Who is Georgios Lappas\nand how was the counterfeit mortgage prepared?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The arrested Lappas is 46 years old and married to a\nBulgarian citizen, <em>To Vima<\/em> reports. In\nthe Bulgarian registers, he is entered with the name Georgios Polykapos Lappas\nin connection with the companies <a href=\"https:\/\/tr.bivol.bg\/view.php?guid=A7EC14949BB562908B3DFBAD8322E623&amp;q=%D0%BB%D0%B0%D0%BF%D0%B0%D1%81\">Design\nShops<\/a> and GL Consulting companies, according to a check by Bivol. A person\nnamed Georgios Lappas is the creditor of another company of a Greek citizen\nand, at his request, there is a freeze on assets worth EUR 40,000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Maritime.bg<\/em> <a href=\"https:\/\/www.maritime.bg\/50299\/\">published<\/a> the notary&#8217;s complaint to\nthe Greek Prosecutor&#8217;s Office, detailing how the fraud had occurred. On August\n24, 2017, Georgios Lampas presented himself to Andreadaki as a mediator between\nBulgargeomin and the Libyan company Libyan Navigator, who had asked him to sign\na Maritime Mortgage Agreement. She prepared the papers and handed the drafts to\nGeorgios Lappas to show them to the Bulgargeomin proxies and the Libyan side.\nAt one of the meetings he came with the representative of Bulgargeomin <strong>Assen Kavdansky<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the mortgage has not been signed as the parties\nhave failed to appear on the scheduled day. According to the notary, the draft,\nwhich has remained with Lappas, has been forged later with Andreadaki\u2019s\nsignature and seal. An apostille from the court in Athens has been issued for\nthe counterfeit. After learning about the fake document from a Greek colleague,\nthe notary immediately, (on November 28, 2017), filed a complaint with the\nProsecutor\u2019s Office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Referring to precisely the above mentioned apostille, Bulgarian\nTransport Minister Rossen Zhelyazkov announced that Bulgargeomin documents are\nlegit, the maritime mortgage is valid and it was a &#8220;civil legal&#8221;\ndispute. This happened after the eruption of the scandal with the hijacking of\nBADR and the removal of its crew by a group of thugs with the help of border\npolice and Maritime Administration. The Minister, however, failed to specify\nthat Bulgargeomin has nothing to do with the former State-owned firm that had\nworked in Libya during the times of the Communist regime. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>It becomes only now\nclear that the Prosecutor&#8217;s Office had known about the counterfeit as early as\nthe end of 2017 and had officially requested the arrest of George Lappas in\nearly 2018.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The press office of the Prosecutor General did not answer\nthe questions about what have been the pre-trial proceedings that have become\ngrounds for the requested EAW against Lappas and on what date this has been\ndone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On March 5, the Bulgarian National Radio reported that the\ntanker is already registered to a Liberian company, although the ownership has\nnot been changed in the official registers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cTitans\u201d, former\nState Security agents and Investbank behind Bulgargeomin <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bulgargeomin Ltd Association includes the companies\nTectona, Moran Trade and Moran West. Formally it is managed by the individual\nVentsislav Krastev from the western city Pernik, to whose name companies of <strong>Dimitar Yosifov<\/strong>, the well-known owner\nof the waste disposal and management company Titan, were transferred in the\nbeginning of 2018 as well.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It was Yosifov who appeared before the Court of Appeals in\nBurgas as a proxy of Bulgargeomin, together with Kostadin Anakiev. They claimed\nthat Bulgargeomin had bought in 1995 from the insolvent State-owned company\nBulgargeomin a receivable from the Libyan company. Another proxy, Assen\nKavdansky, appeared before the media. This is the same Kavdansky who has\nvisited the office of the Greek notary together with Georgios Lappas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He is also closely connected to the group linked to Tectona,\naccording to the data from Bulgarian Trade Registry. The group involves\namphetamine (captagone) trafficker Tsvetan Tsanev and Investbank\u2019s banker <strong>Dimitriika Andreeva<\/strong>, who represents an\n\u201cOmani investor\u201d in the Bank.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In an earlier investigation by Bivol, in partnership with\nItalian colleagues from&nbsp;<a href=\"https:\/\/irpi.eu\/en\/mafia-in-africa\/\">IRPI<\/a>\/<a href=\"http:\/\/investigativecenters.org\/\">ANCIR<\/a>&nbsp;entitled \u201cMafia in\nAfrica\u201d, Tsvetan Tsanev appears as a European investor in a joint venture for\ndiamond trade with a Cosa Nostra boss.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Attorney Tsvetan Tsanev is also a key figure in the &#8220;<a href=\"https:\/\/bivol.bg\/en\/venezuelan-laundromat-russian-oil-and-bulgarian-intelligence-officers-part-i.html\">Venezuelan\nLaundromat<\/a>&#8221; affair. According to the US authorities, hundreds of\nmillions of dollars of the regime of Nikolas Maduro have passed through a\nlawyer\u2019s account opened in Investbank&#8217;s on Tsanev\u2019s behalf. The Greek newspaper\n<a href=\"https:\/\/www.tovima.gr\/2019\/03\/05\/society\/synelifthi-ellinas-mesazon-stin-ypothesi-metaforas-kefalaion-apo-venezouela-se-voulgaria\/\"><em>To Vima<\/em><\/a> also tells this story in the\ncontext of Lappas&#8217; arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bivol\u2019s investigation into the \u201cVenezuelan Laundromat\u201d <a href=\"https:\/\/bivol.bg\/en\/venezuelan-laundromat-russian-oil-and-bulgarian-intelligence-officers-part-i.html\">showed<\/a>\nthat Tsanev is part of a complex business structure involving Russian oil\ncompanies linked to individuals from so-called \u201cBankya Circle\u201d. One of these\nindividuals is&nbsp;<strong>Dimitar Sabev<\/strong>, whose relative&nbsp;<strong>Nedyalko\nNedyalkov<\/strong>&nbsp;is a Deputy Head of Bulgaria\u2019s National Security Agency\n(DANS), the institution tasked with detecting cases of money laundering.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Asked to comment on these facts, Prime Minister Boyko\nBorisov ordered the Director of DANS to carry out a probe, which should be\ncompleted by now.
