{"id":45937,"date":"2019-03-10T16:20:00","date_gmt":"2019-03-10T14:20:00","guid":{"rendered":"https:\/\/bivol.bg\/?p=45937"},"modified":"2019-03-11T09:20:16","modified_gmt":"2019-03-11T07:20:16","slug":"prosecutors-office-does-not-perceive-corruption-in-riagate-but-actively-hunts-source-and-will-question-journalists-of-bivol","status":"publish","type":"post","link":"https:\/\/bivol.bg\/en\/prosecutors-office-does-not-perceive-corruption-in-riagate-but-actively-hunts-source-and-will-question-journalists-of-bivol.html","title":{"rendered":"Prosecutor\u2019s Office Does Not \u2018Perceive\u2019 Corruption in #RIAGate but Actively Hunts Source and Will Question Journalists of Bivol"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">As in other emblematic cases of leaked recordings of\nconversations between high-ranking officials, the Prosecutor\u2019s Office is ignoring\nevidence of corruption and is searching only for the source of the recording.\nThis is clear from prosecutor&#8217;s case 6917\/2019 on the docket of the Sofia City\nProsecutor&#8217;s Office (SCPO), in connection with which Bivol was urged to provide\nthe recoding published in the article\n<a href=\"https:\/\/bivol.bg\/en\/riagate-lets-give-a-hand-to-ivan-we-have-a-deal.html\">\u201c#RIAGate; &#8216;Let&#8217;s Give a Hand to Ivan\u2026 We Have a\nDeal\u201d<\/a>, while journalists of the site are summoned to give\nexplanations in the General Directorate National Police (GDNP).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a recording of a conversation between <strong>Mihail Rashkov<\/strong>, a Director at the\nBulgarian Road Infrastructure Agency (RIA) and a lady, who has been identified\nin other media publications but not by Bivol as <strong>Dessislava Hristova<\/strong>, Member of the Managing Board of the State-owned\ncompany Avtomagistrali JSC (Highways JSC, a State company tasked with the\nmaintenance of the country\u2019s highways \u2013 editor\u2019s note).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The conversation between the two reveals the scheme and the mechanism\nby which the money for the \u201cHemus\u201d highway that will connect the capital Sofia\nwith the Black Sea city of Varna will be utilized \u2013 through non-transparent\nassignments to some companies, without public procurement but to \u201cour people\u201d\nto whom influential persons \u201care giving a hand\u201d. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, some Ivan is being discussed, who is already\nbuilding at a \u201cpilot\u201d site near Malo Buchino (village near Sofia \u2013 editor\u2019s\nnote). The site had been assigned to Avtomagistrali JSC by the RIA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ivan should be given a hand because he is working hard and is\n\u201cready to absolutely do everything possible\u201d. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;<em>And about Ivan, this\nis it, I stand behind his strength, you stand beside me, he is the right person<\/em>,&#8221;\nthe female voice tells Rashkov.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A few days after our January 29 article, <strong>Dessislava Hristova<\/strong>, who was not\nidentified in our initial publication, submitted a surprising resignation as a\nmember of the Board of Avtomagistrali. Subsequent to a publication of the newspaper\n<em>Sega<\/em> (Now), it became clear that on\nFebruary 11, Hristova had filed a signal with Prosecutor General, Sotir\nTsatsarov, asking for the prosecution to request the recording from Bivol\u2019s\neditorial office and to check for its authenticity and legality as well as \u201cfor\ncrimes committed by me resulting from the contents of the recording in question\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As Bivol indicated, the conversation has been accidentally\nrecorded by a driver who has called the Road Infrastructure Agency, using phone\nnumber 02 9173 376, which, according to the RIA phonebook, is the office number\nof engineer <strong>Mihail Rashkov<\/strong>, Director\nof the \u201cRoad Infrastructure Maintenance\u201d Directorate. It seems that the\nrecording has resulted from a blunder by the telephone exchange. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Prosecutor&#8217;s Office has acted on Hristova\u2019s signal and\nhas assigned the case to the SCPO, which has commissioned a probe to the GDNP. Bivol\u2019s\neditorial office has already sent via email to the GDNP the full recording that\nis available to it. From the original recording, we have deleted only the words\n&#8220;Hello, hello&#8221;, pronounced by the driver with the hope that someone\nin the RIA would answer his request for information. This was done solely for\nthe purpose of protecting the identity of the source and has been explicitly\ncommunicated to the GDNP in the accompanying letter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Prosecutors have no \u201cperception\u201d\nof corruption<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(According to Transparency International\u2019s latest Corruption&nbsp;Perceptions&nbsp;Index, Bulgaria ranks 77<sup>th<\/sup>\nglobally, something that has been dismissed by the country\u2019s rulers as \u201cjust\nperception\u201d \u2013 editor\u2019s note.)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;It is a fact that the Public Prosecutor\u2019s Office did\nnot react at all to our publication from January 29, but at the same time, it\nresponded in minutes after another recording involving the current Minister of\nCulture was submitted by a lawmaker from the Bulgarian Socialist Party.\nProbably there would have been no reaction until now, if it was not for the\nformal signal of Hristova to Tsatsarov.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This again shows the <strong>prosecution\u2019s\ndouble standard<\/strong>, which silently ignores evidence of crimes committed by the\nhigh echelons of power. The recording also mentions Prime Minister Boyko Borisov,\nwho wanted to cut the ribbon on the site constructed by the mysterious Ivan as\nwell as the Executive Director of Avtomagistrali JSC, <strong>Stoyan Belichev<\/strong>, for whom it had been known that he is close\nto&nbsp;<strong><a href=\"https:\/\/bivol.bg\/en?s=Ginka+Varbakova\">Ginka Varbakova<\/a><\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The schemes where non-transparent billions are absorbed are\nalso taboos for investigators. Precisely Avtomagistrali was commissioned to\nbuild the Hemus highway for more than BGN 1.4 billion despite the fact that the\nState-owned company had neither equipment nor experience in such large sited.\nBut there is some &#8220;Ivan&#8221;, and probably also some other trusted men to\nwhom someone &#8220;will give a hand&#8221;. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bivol stated already, in its first publication, that it\nwould provide the original of the recording if the Prosecutor&#8217;s Office \u201cperceives\u201d\nsome corruption, but obviously there is no such thing to date. Otherwise, the\ncase would have been allocated to the specialized Prosecutor&#8217;s Office and not\nto the Sofia City Prosecutor&#8217;s Office, which is the competent body to\ninvestigate the source of the recording, but not the corrupt actions mentioned\nin it. This was the case with the #<a href=\"https:\/\/bivol.bg\/en?s=YanevaGate\">YanevaGate<\/a>\nrecordings, which were also not probed for evidence of corruption, but only for\nwho had made them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also suspicious is the assignment of the case to the GDNP,\nwhich is competent to collect data on prosecution cases from abroad. As Bivol has\nlearned from its sources, in the course of the YanevaGate investigation, the\nmonitoring prosecutor <strong>Dimitar Frantisek\nPetrov has requested and received from the French Prosecutor&#8217;s Office\npermission to raid Bivol\u2019s server in France<\/strong> to seize the recordings. At the\nsame time, the Supreme Judicial Council (SJC) urged Bivol to provide all the\naudio files we published in parts, while Sotir Tsatsarov and SJC member Yassen\nTodorov launched brutal attacks and insults against Bivol.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, no raid ever happened, probably because of the\njudgment that the public reaction of such an attack against an investigative\nmedia in a European Union Member State would result in more negatives than\npositive results for the country\u2019s rulers or results fit to yield criminal\ncharges. And the results would have been zero, because Bivol generally does not\nstore sensitive information on public servers that are accessible to the authorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From what we know so far, we can conclude that the\ninvestigation into the #RIAGate recordings follows the same prosecutorial pattern\nas the investigation into the recordings from #YanevaGate. The difference is that\nthe #RIAGate stakes are much more modest for individual people. For example, they\ndo not involve Prosecutor General Tsatsarov, who in the stories told by Judge\nVladimir Yaneva before Judge Chenalova and attorney Mondeshki was portrayed as\na person abusing power and authority.
